Biobanks are increasingly being created specifically for research purposes. Concomitantly, we are seeing significant and evolving shifts in research ethics in relation to biobanking. Three discrete shifts are identified in this article. The first extends the ethical focus beyond the protection of human subjects to the promotion of broader community benefits of research utilizing biobanked resources, and an expectation that these benefits will be shared. The second involves the evolution of the traditional consent paradigm for future research uses of biobanks (...) resources that are not in contemplation at the time of donation. The third involves a move away from single project management to more dynamic governance accountability to research participants and the public. These shifts may take different local and institutional forms but share common recognizable elements. (shrink)

The ability to sustain antibiotic efficacy is directly affected by incentive models aiming to stimulate antibiotic research and development. This paper analyzes the extent to which the models proposed by the Innovative Medicine Initiative-funded research project DRIVE-AB can be expected to support sustainable use, drawing on basic economic theory and the incentives that derive from it. This report describes a consultation case between a special education teacher and a school psychology student for a first grade student with a diagnosis of educable mental impairment. Adherence to data-based decision making and direct manipulation of hypothesized variables believed to be maintaining problem behaviors in the classroom revealed factors that were influencing the child’s behavior in the classroom. The teacher changed her behavior toward the student before a formal intervention plan could be developed and changes in student behavior were (...) observed. Child outcomes were systematically measured. Also, the acceptability of the consultation process was assessed. Results are discussed in terms of the possible reactive effects to behavioral consultation and functional assessment that may occurfor teachers who see solutions enlerge during data-based consultative problem solving. Affective variables have been shown to impact working memory and cognitive control. Theoretical arguments suggest that the functional impact of emotion on cognition might be mediated through shifting action dispositions related to changes in motivational orientation. The current study examined the effects of positive and negative affect on performance via direct manipulation of motivational state in tasks with high demands on cognitive control. Experiment 1 examined the effects of monetary reward on task-switching performance, while Experiment 2 examined the effects of (...) both rewards and punishments on working memory, using primary (liquid) reinforcers. In both experiments, dissociable trial-by-trial and contextual (block-related) enhancements of cognitive control during task performance were observed in relationship to motivational incentive value. Performance enhancements were equivalent in the reward and punishment conditions, but were differentially impacted by individual difference measures of trait reward and punishment sensitivity. Together, the results suggest both common and specific mechanisms by which approach and avoidance motivational states influence cognitive control, via activation of reward and punishment processing systems. Owing to unique features of their design, cluster randomized trials complicate the interpretation of standard ethics guidelines. The recently published Ottawa statement on the ethical design and conduct of cluster randomized trials provides researchers and research ethics committees with detailed guidance on the design, conduct and review of cluster trials. The Ottawa statement sets out 15 recommendations, including guidance on the justification of study design, the need for research ethics committee review, the identification of research participants, obtaining informed consent, the (...) role of gatekeepers in protecting cluster interests, the assessment of benefits and harms, and the protection of vulnerable participants. Earth system science (ESS) has identified worrying trends in the human impact on fundamental planetary systems. In this conceptual article, we discuss the implications of this research for business schools and management education (ME). We argue that ESS findings raise significant concerns about the relationship between business and nature and, consequently, a radical reframing is required to embed economic and social activity within the global sustainability of natural systems. This has transformative implications for ME. To illustrate this reframing, we apply (...) the ESS lenses of social-ecological interdependence, multiscalar relations, environmental governance, and environmental values to the ME functional domains of institutional purpose, social context and engagement, pedagogical practice, curricular design, and research focus. Our work contributes to the literature on business education for sustainability and the business-society-nature nexus. We explore and apply key ESS findings and concepts, discuss normative implications of these ideas, and offer guidance on transformational pathways for business schools and ME. (shrink)

The focus of this study was to analyze the content, distribution, and comparative genome relationships of 996 chromosome bin-mapped expressed sequence tags accounting for 2266 restriction fragments on the homoeologous group 3 chromosomes of hexaploid wheat. Of these loci, 634, 884, and 748 were mapped on chromosomes 3A, 3B, and 3D, respectively. The individual chromosome bin maps revealed bins with a high density of mapped ESTs in the distal region and bins of low density in the proximal region of the (...) chromosome arms, with the exception of 3DS and 3DL. These distributions were more localized on the higher-resolution group 3 consensus map with intermediate regions of high-mapped-EST density on both chromosome arms. Gene ontology classification of mapped ESTs was not significantly different for homoeologous group 3 chromosomes compared to the other groups. A combined analysis of the individual bin maps using 537 of the mapped ESTs revealed rearrangements between the group 3 chromosomes. Approximately 232 of the consensus mapped ESTs matched sequences on rice chromosome 1 and revealed large- and small-scale differences in gene order. Of the group 3 mapped EST unigenes ∼21 and 32% matched the Arabidopsis coding regions and proteins, respectively, but no chromosome-level gene order conservation was detected. (shrink)

Depression is ranked as most common type of mental illness by the World Health Organization. Although cognitive behavioural therapy is recommended as the evidence-based psychological treatment of choice, this applies mostly to youthful, attractive, verbal, intelligent and successful persons with medical aid support in high income countries. More holistic counselling that includes holistic, verbal and non-verbal, expressive therapeutic modalities are more suitable for the planetary majority. Consequently, this study describes the process and effectiveness of philophonetics counselling with a sample of (...) ten depressed clients seeking clinical psychological services in Zululand, South Africa, a region and country beset with considerable violence, crime illness and unemployment. Client reports of effectiveness of philophonetics counselling warrants further intervention and evaluative research, with special reference to wider community psychological applications of this expressive therapeutic modality via primary health care facilities, online courses and mobile technology. In Daubert v. Merrell Dow Pharmaceuticals, Inc., the U.S. Supreme Court made its first major pronouncement on the evaluation of scientific evidence, calling on judges to act as gatekeepers for scientific knowledge and validity, despite lack of scientific training among judges. Daubert offers the science studies community a case study for examining how judges engage in boundary-work and construct scientific validity. In constructing scientific validity under Daubert, judges must evaluate the scientific method behind a particular scientific claim, and will look (...) to the parties' experts and the relevant scientific community for assistance. To combat the oft-cited problem of the battle of the experts, judges may be tempted to obtain assistance from court-appointed neutral experts, an inquisitorial system in the civil law tradition of many European countries. The judicial evaluation of scientific evidence, the resulting construction of scientific validity, and the push for a greater use of court-appointed experts reveal judges' desire to segregate "objective" scientific facts from aspects of the legal process that are infused with adversaries' values. Yet the scientific and judicial construction of validity mixes empirical results and research methods with the personal, political, and institutional values of judges and scientists. (shrink)

This book celebrates the work of Patricia Werhane, an iconic figure in business ethics. This festschrift is a collection of articles that build on Werhane’s contributions to business ethics in such areas as Employee Rights, the Legacy of Adam Smith, Moral Imagination, Women in Business, the development of the field of business ethics, and her contributions to such fields as Health Care, Education, Teaching, and Philosophy. Late in life, Józef Maria Bocheński set out to examine the age-old preoccupation with the question “how to live as well and as long as possible?” A traditional answer has been, “live wisely.” In his Handbook of Worldly Wisdom (2020), Bocheński analyzes this answer arguing that, conceptually, living wisely is distinct from obeying moral commandments, prescribing ethical rules, and recognizing authority (e.g., piety, free submission to divine authority). He claims that ethics consists solely in what moral philosophers label as “metaethics” (...) — a theoretical discipline interested in the conceptual status of moral discourse qua discourse. However, Bocheński remains silent about a substantive ethics — that is, how a life led one way or another subscribes to some guiding value-set. As regards wisdom, therefore, the consequence of this position is that Bocheński’s account is ethically neutral. I argue that such a position entails a tension and dichotomy between, on the one hand, prudential rationality concerned with getting on in the moment — that is, wisdom — and, on the other hand, unconditional moral commandments. For his part, Bocheński does not recommend living according to wisdom’s precepts as he analyses them; his own path through life, he tells us, has been a commitment to Christian values, piety abetted by observance of moral commandments, a perspective that, I submit, is not ethically neutral: on the contrary, it entails thick, substantive value-choice. Bocheński’s avowal suggests a second dichotomy and tension, that between the worldly conduct of life, with moderate acknowledgment of moral principles, and an extra-worldly perspective (the “folly of the Cross”). Bocheński does not attempt to resolve either dichotomy, to seek a possible point of their convergence and integration, for instance by inquiring into moral psychology (i.e., the construction of self, the nature of the will, etc.). I believe that this set of views stems from conclusions Bocheński reached in advance of producing the Handbook that bear on, first, how philosophy should be conducted — as logical analysis hostile to grandiloquent speculation and synthesis (“worldviews”); and second, his utter dismissal as nefarious of anthropocentric views. Indeed, Bocheński asserts, without a blush, that almost everything “we” have come to believe about ourselves is superstition writ large. I trace what I consider to be difficulties with Bocheński’s account of wisdom — in relation to his take on morality, (meta-)ethics, and piety — to these idiosyncratic views. (shrink)

The focus of this chapter is the rise of investigations in philosophical aesthetics in the mid-1950s and continuing through to the mid-1960s. This salient issue had to do with the foundations of philosophical aesthetics in the context of the Marxist-Leninist worldview. That this became an issue was due in large part to the appearance, in 1956, of the first Russian translation of Marx’s Economic and Philosophical Manuscripts of 1844. Marx’s emphasis in these writings on the self-constituting, transformative potential of labor (...) suggested possibilities for an aesthetic that did not sit comfortably with the dogmatic principles of dialectical and historical materialism. In effect, the foundational question for a Soviet aesthetics went to the heart of Marxism-Leninism: could young Marx’s anthropocentrism be reconciled with the established Soviet doctrine beholden to, on the one hand, Engels’ metaphysics of “matter-in-motion” and, on the other hand, Lenin’s copy theory of knowledge? Among the aestheticians, the issue surfaced in a debate about the nature of beauty: is beauty relative to man or is it an objectively cognizable material property? To the degree that the parties to this debate addressed the underlying issue, they tended to remain ambivalent toward the result that neither side—those favoring creative expression versus the defenders of objective beauty—simply conceded nor rejected the views of the other. As I argue, a systematic philosophical aesthetics within the scope of Soviet philosophy never saw the light of day. By the mid-1960s, research was ramifying into a variety of adjacent considerations, for example, value theory, theories of culture and cultural artifacts, the history of aesthetic categories, the social and pedagogical functions of art, art and morality in relation to the “socialist way of life,” art in the era of the “scientific-technological revolution,” and so on—of which only some recalled the spirit, rarely the letter, of the initial “aesthetics” discussion. This article investigates a high-profile and ongoing dilemma for healthcare professionals (HCPs), namely whether the existence of a (legal) duty of care to genetic relatives of a patient is a help or a hindrance in deciding what to do in cases where a patient’s genetic information may have relevance to the health of the patient’s family members. The English caseABC v St George’s Healthcare NHS Trust and othersconsidered if a duty of confidentiality owed to the patient and a putative duty (...) of care to the patient’s close relatives could coexist in this context. This article examines whether embracing the concept of coexisting duties could enable HCPs to respect duties in line with their clinical judgement, thereby providing legal support and clarity to professionals to allow them to provide the best possible genetics service to both the patient and their family. We argue that these dual duties, framed as a novel, composite duty to consider the interests of genetic relatives, could allow HCPs to exercise and act on their professional judgements about the relative value of information to family members, without fears of liability for negligence or breach of confidence. One of the most ingenious arguments in all of Attic oratory is to be found in the speech Lysias wrote for Euphiletus to deliver at his trial for the murder of Eratosthenes . In his speech Euphiletus first describes to the court how his wife was seduced by Eratosthenes, then recounts how he discovered the affair, caught the adulterer in the act, and, despite an offer to pay compensation, slew him. Euphiletus defends his action by citing the law of the (...) Areopagus that whoever kills an adulterer caught in flagranti with his wife cannot be convicted of murder. Euphiletus further points out that the same exemption applies to the man who catches someone seducing his pallakē. If the lawgiver regarded the seduction of a pallakē as so serious that it merited the death penalty, Euphiletus argues, he must have regarded the seduction of a wife as even more reprehensible, deserving a penalty worse than death.
